Is auto dialer legal? As a tool, yes, in every country covered here. What the law controls is the call: consent, do-not-call registers, hours and recorded voices. The Auto Dialer lists the rules with official sources.
This page is general information, not legal advice. It summarises statutes and regulator pages read on 4 October 2026 and has not been reviewed by a lawyer. It does not cover United States state laws, which can be stricter than federal law. Before a calling campaign, check the current rules for the country you are calling.
Country by country, is auto dialer legal?
The Auto Dialer compared the telemarketing rules of 5 countries, and the pattern is the same in each. None of them prohibits auto dialing software. Each one regulates unsolicited sales calls through a national do-not-call register, a consent or relationship test, and often a limit on calling hours. On top of that, most have a stricter rule for one technology: calls that play a recorded or artificial voice, and dialers that leave people listening to silence. A dialer that connects a live person on every call, one number at a time, sits outside those stricter rules but inside the ordinary telemarketing ones. The law that applies is the law of the place you are calling.

United States: is auto dialer legal under the TCPA
The Telephone Consumer Protection Act defines an "automatic telephone dialing system" as equipment with the capacity to store or produce numbers "using a random or sequential number generator" and to dial them. In Facebook v. Duguid (1 April 2021) the Supreme Court held that this number-generator capacity is a necessary feature of an autodialer. Calls to mobile numbers made with such a system, or with an artificial or prerecorded voice, need the called party's prior express consent, and written consent for telemarketing.
- Do not call. Telephone solicitations may not be made to residential subscribers on the national registry, and the FCC applies this to wireless numbers too.
- Existing relationship. A purchase within the previous 18 months, or an inquiry within the previous 3 months, creates an established business relationship. The FTC's rule words these as 540 days and 90 days.
- Hours. No solicitation before 8 a.m. or after 9 p.m. at the called party's location.
- Penalties. The statute allows a private claim of up to $500 for each violation. The FTC states fines of up to $53,088 per violation of its rule, a figure that is adjusted for inflation.
United Kingdom: is auto dialer legal under PECR
The Privacy and Electronic Communications Regulations split calls in two. Regulation 19 covers an "automated calling or communication system", defined as one that starts a sequence of calls from stored instructions and transmits sounds "which are not live speech"; marketing by recorded message needs consent. Live marketing calls fall under regulation 21.
- Do not call. No unsolicited marketing calls to a number on the TPS or Corporate TPS register, or to anyone who has told you not to call, unless that person has specifically consented.
- Caller identity. The caller must not withhold the calling line identity. A SIM based dialer shows your own number.
- Silent and abandoned calls. Ofcom's persistent misuse policy says calling parties should not make them, and Ofcom can impose penalties of up to £2 million.
- Fines under PECR. The ICO's own pages currently give different maximum amounts, so no figure is quoted here.
Canada: is auto dialer legal under CRTC rules
The CRTC's rules name two technologies. An Automatic Dialing-Announcing Device (ADAD) is equipment that stores or produces numbers "to convey a pre-recorded or synthesized voice message". A predictive dialing device is software that "automatically initiates outgoing telecommunications from a pre-determined list" of numbers, and a telemarketer using one must not exceed a 5 percent abandonment rate in a calendar month. That second definition is broad, and the text read does not say whether one-at-a-time dialing with the caller on the line falls inside it; such a dialer produces no abandoned calls either way.
- Do not call. No telemarketing to a number on the National DNCL without express consent. The list version used must be no more than 31 days old. The DNCL rules do not apply to calls to business consumers.
- Existing relationship. 18 months after a purchase and 6 months after an inquiry or application.
- Hours. 9:00 a.m. to 9:30 p.m. on weekdays and 10:00 a.m. to 6:00 p.m. on weekends, in the consumer's time. Stricter provincial hours prevail.
- Penalties. Up to $1,500 for an individual and up to $15,000 for a corporation, for every contravention.
Australia: is auto dialer legal under telemarketing rules
Neither the Do Not Call Register Act nor the industry standard defines an autodialer. The rules attach to any "telemarketing call", however it is dialled, and a voice call includes one with a recorded or synthetic voice.
- Do not call. No telemarketing call to an Australian number on the register unless the person consented. Telemarketers have 30 days to recognise a new registration.
- Consent. Express consent, or consent reasonably inferred from conduct and from the business relationship. Express consent with no stated period lapses after 3 months.
- Hours. No call before 9 am or after 8 pm on a weekday, before 9 am or after 5 pm on a Saturday, or on a Sunday or a national public holiday, at the account-holder's address.
- Penalties. Set in penalty units, not dollars, in the Act.

India is the strictest of the five about the line itself: TRAI does not permit telemarketing from an ordinary mobile number, and its September 2026 amendment added a declaration rule for software-initiated calls. - Identify the country of every number on the list. The rules follow the person called.
- Remove numbers on that country's do-not-call register unless you hold consent or a valid relationship exemption.
- Record how and when each person became a customer or enquired. In The Auto Dialer each lead carries a source tag and a dated history.

Is an automatic dialer illegal?
No. In the five countries covered here, no law bans the automatic dialer as a tool. The laws regulate telemarketing calls: who may be called, with what consent, at what hours, and whether a recorded voice is used.
Is it legal to use The Auto Dialer in my country?
The Auto Dialer is a tool that places ordinary calls from your own SIM to a list you supply, and it connects a live person, never a recording. Whether each call is lawful depends on your country’s rules and on your relationship with the person called, which is your responsibility to check.
Which auto dialer avoids abandoned and silent calls?
A one-at-a-time dialer avoids them by design. The Auto Dialer places one call per phone with the caller already on the line, so there is never an answered call with nobody there. Abandoned calls come from predictive dialers that dial several numbers per agent.
Do I need consent to auto dial my own customers?
It depends on the country. The United States and Canada have a written existing business relationship exemption with time limits. The United Kingdom’s regulation 21 has none. Australia allows consent inferred from the relationship. The table on this page gives the periods.
What hours can I make sales calls?

Does the United States TCPA definition cover every auto dialer?
The statute defines an automatic telephone dialing system by whether it can generate numbers randomly or in sequence, and in 2021 the Supreme Court held that this number-generating ability is essential. Do-not-call and calling-hour rules apply to telemarketing calls however they are dialled, and state laws may be wider.
