Is auto dialer legal in India? The tool is not banned. TRAI's rules decide which calls you may place with it, from which number, and to whom. The Auto Dialer sets out the official position with sources.

Short verdict: is auto dialer legal in India today

The Auto Dialer publishes this summary because the answer changed recently. The governing rules are the Telecom Commercial Communications Customer Preference Regulations, 2018 (TCCCPR), issued by the Telecom Regulatory Authority of India. They do not prohibit auto dialers. They regulate commercial communication: calls whose primary purpose is to inform about, advertise or solicit business for goods or services. On 12 February 2025 TRAI's Second Amendment restricted senders from using normal 10-digit numbers for telemarketing and required senders to notify their operator, in writing and in advance, about the use of auto dialers or robo-calls. On 18 September 2026 the Third Amendment replaced that with a wider rule on Application-to-Person (A2P) calls and set a 7 day limit on calling someone on the strength of an enquiry.

Personal mobile numbers and is auto dialer legal in India

TRAI's own FAQ asks whether a mobile number may be used for telemarketing and answers no: a connection used to send promotional communication is liable to disconnection, and the subscriber may be blacklisted. That applies whether the number is dialled by hand or by an app. So a SIM based auto dialer does not turn a personal number into a telemarketing line. Two kinds of call fit the rules better:

A2P calls and phone apps: is auto dialer legal in India

The open question is whether a list dialled by an app on a handset counts as an A2P call. The Third Amendment does not name phone apps either way. Its definition is broad, covering calls initiated by an application without direct human dialling, and TRAI declined to exclude calls that connect to a live person. Until TRAI or your operator says otherwise, treat it as possible that app-dialled commercial calls need declaring, and ask your operator in writing. We do not describe The Auto Dialer as "TRAI compliant" or "approved", because no such certification exists for a dialer.

Compliance checklist for is auto dialer legal in India

  1. Sort your list by reason for calling: existing customer, recent enquiry, or neither. Do not auto dial the third group from a mobile number.
  2. Keep proof of each enquiry: the form entry, message or sheet row with its date. In The Auto Dialer every lead carries a source tag and a full history.
  3. Call enquiries promptly. The seven day window is short, and a follow-up reminder helps you stay inside it.
  4. Keep retries low. Complaints from five recipients in ten days can trigger action; see the auto redial settings.
  5. Honour "do not call me" and keep your own do not call list: use excluded numbers and the block list so that person is never dialled again.

Is an automatic dialer illegal?

No law in India bans the automatic dialer as a tool. TRAI regulates the calls made with it: commercial calls must come from registered senders on designated number series, and software-initiated calls have to be declared to the telecom operator in advance.

Is cold calling illegal in India?

Promotional calls to people who have not asked for them are restricted. TRAI’s FAQ says a mobile number may not be used for telemarketing, and promotional calls are meant to go out on the 140 series from registered senders, respecting each person’s Do Not Disturb preference.

Is The Auto Dialer legal to use in India?

The Auto Dialer is a calling tool, and whether a call is allowed depends on who you call and why. It is intended for calling your own customers and people who recently enquired with your business.
