The FCC's do-not-call safe harbor in 47 CFR 64.1200(c)(2) protects a business from an honest mistake only if it has written procedures, trained staff, its own list of numbers it may not call, and a process using a registry version no more than 31 days old, with records showing that process ran. Access to the registry data must be bought from the registry's administrator. Separately, a company that makes telemarketing calls must keep a written do-not-call policy available on demand, record a stop request at the time it is made, honour it within 10 business days and keep it for 5 years. A live-call dialer changes none of that. What it does change is narrower: no prerecorded voice is ever played, and no answered call is left waiting for an agent.

Auto dialer USA calling hours by time zone
The window is set by where the called person is, so a team calling coast to coast works several windows at once. When it is 8 a.m. in Los Angeles it is already 11 a.m. in New York, and when New York reaches 9 p.m., Los Angeles is at 6 p.m. Alaska and Hawaii sit further back still. The Auto Dialer has no automatic time-zone gate, so build it into the list:
- Add a custom lead field for time zone or state, filled from your form or sheet when the lead is created.
- Filter the list by that field and start a session for one zone at a time, beginning with the zone where the window opens first.
- Treat the area code as a hint only: a mobile number keeps its area code when its owner moves, so the record's address is better evidence.
- Stop each zone's session well before its 9 p.m., and set follow-up reminders for anyone who asked to be called later.
Auto dialer USA consent records
For telemarketing calls made with an autodialer or a prerecorded voice to mobile numbers, the FCC requires prior express written consent. To call a registered number on the strength of permission rather than a relationship, the permission has to be a signed written agreement that names the seller and includes the number to be called. The Auto Dialer does not collect signatures, but each lead can carry a source tag, a custom "consent date" or "consent text" field, and the signed form itself stored in My Docs, so the evidence sits one tap from the number.
