Auto Dialer UK Guide to TPS Screening, PECR and Ofcom Silent-Call Rules

An auto dialer UK teams use is regulated through the call, not the software. The Auto Dialer explains how PECR splits live from recorded calls, how TPS screening fits into a calling day, and where one-at-a-time dialing helps.

This is general information, not legal advice. Compiled from PECR, ICO guidance and an Ofcom statement on 4 October 2026; no PECR fine figure is given because the ICO's own pages differ.

Auto dialer UK law under PECR

The Auto Dialer sits on the live side of the line that the Privacy and Electronic Communications Regulations 2003 draw. Regulation 19 deals with automated systems whose calls carry "sounds which are not live speech", and marketing by that route needs the subscriber's consent. Every call this app makes connects a person talking, so the live-call rules in regulation 21 are the ones that apply. A number registered with the TPS or the Corporate TPS may not receive an unsolicited marketing call, and nor may anyone who has asked you to stop, except where that subscriber has specifically agreed to hear from you. Regulation 21 has no exemption for existing customers, unlike the US auto dialer rules or the Canadian rules. Calling a number listed for less than 28 days is not yet a breach. The caller's number must not be withheld; a SIM-based call shows the mobile number of the person calling. UK readers may know the product category as a dialler, a spelling covered on dialer or dialler.

Auto dialer UK rules by TPS status and number type

Who you are calling, and what PECR, the ICO and Ofcom say. Sources read 4 October 2026.
Number belongs to Rule Timing Source

Sole trader Can register on the TPS rather than the CTPS, so screen business lists against both As for any TPS number ICO guidance
Company on the Corporate TPS No unsolicited live marketing call without specific consent As above PECR reg. 21
Business on neither register Live marketing calls allowed unless it has asked you to stop At any point it objects, stop ICO guidance
Anyone who said "don't call" No further marketing calls; keep them on your own list From the moment they say it PECR reg. 21; ICO guidance

Auto dialer UK calling day

A UK team using The Auto Dialer can fold the rules into a routine like this:

  1. Screen the list against the TPS and CTPS before import, and note the screening date in the list name.
  2. Import the screened file; the app drops duplicate numbers and handles the +44 country code as it imports.
  3. For any registered number you still intend to call, record where the specific consent came from in a custom field, with the source tag set.
  4. Open each call by saying who is calling and on whose behalf. If asked, give a contact address or freephone number.
  5. When someone says stop, set a "Do not call" status and add the number to excluded numbers before the next call.
  6. Re-screen lists you keep using, because new registrations become binding after 28 days.

PECR, as read for this page, sets no calling hours, so pick sensible ones yourself and say them in your written procedure. Retry settings that keep repeat calls modest are on the auto redial page.

Auto dialer UK and Ofcom silent calls

Ofcom's persistent misuse statement of 20 December 2016 tells callers plainly not to make silent or abandoned calls, and Ofcom's penalties for doing so can reach £2 million. Silent calls are a by-product of dialing ahead of free agents, which is what a predictive system does. A one-line dialer cannot produce them, because the caller is the one placing the call. If you are weighing a predictive setup for a UK floor, read predictive dialer and abandoned call rate first.

Auto dialer UK example

Invented round figures to show the routine, not a client's data.

A lettings manager in Leeds wants to call 400 landlords about a new management package. Screening finds 120 on the TPS and 30 companies on the Corporate TPS. Of those 150, 20 ticked a box on the agency's website agreeing to calls, so they stay, with the consent recorded on each lead; the other 130 come off. That leaves 270 to call across two callers, around 135 each, at 45 a day, three days of calling. Two landlords ask not to be called again; both go straight to excluded numbers.

Auto dialer UK limits

The Auto Dialer does not check numbers against the TPS or CTPS, does not store consent signatures and cannot run recorded campaigns. For a cold B2C campaign into the UK, a platform with TPS screening built in is the better buy. The do not call list guide lines up the other national registers, Australia's rules sit on the dialer for Australia page, and the five-country overview is at auto dialer legality by country.

Auto dialer UK FAQ

11 questions, answered

Is there a do not call list in the UK?

Yes. The Telephone Preference Service (TPS) is the register for individuals, including sole traders, and the Corporate TPS covers companies and other organisations. Under PECR regulation 21, unsolicited live marketing calls may not go to registered numbers unless the person has specifically consented to your calls.

Are auto dialers illegal in the UK?

No. PECR does not ban dialing software. It requires consent for automated calls that play recorded or other non-live sound, sets the TPS rules for live marketing calls, and Ofcom’s persistent misuse policy treats silent and abandoned calls as something callers must avoid.

Which auto dialer for UK teams avoids silent calls?

The Auto Dialer avoids silent calls by design: each phone places one call and the caller is already holding it, so the person who answers always hears someone. Silent calls come from systems that dial more numbers than they have callers free.

Is The Auto Dialer an auto dialer UK businesses can use?

Yes, for live calls, and it shows the caller’s own mobile number, which suits the rule against withholding your number. UK teams still need to screen against the TPS and CTPS, hold specific consent for registered numbers and keep their own do-not-call list.

Can I call a business that is not on the Corporate TPS?

The ICO’s guidance says live marketing calls may be made to a business number that is on neither the TPS nor the Corporate TPS, as long as that business has not told you to stop. Sole traders can register on the ordinary TPS, so check both files.

What is the 28-day rule for the TPS?

Under PECR regulation 21, calling a number that has been on the TPS or Corporate TPS for less than 28 days is not yet a breach. After that, the registration binds. The practical lesson is to re-screen any list you keep using, because yesterday’s clean file can contain numbers registered since. This is general information, not legal advice.

Are there legal calling hours for marketing calls in the UK?

PECR, as read for this page, sets no calling hours, unlike the United States, Canada and Australia. That leaves the choice to the caller, so pick reasonable hours, write them into your calling procedure and keep to them. Persistent or badly timed calls can still draw complaints. This is general information, not legal advice.

What is a silent call in the UK?

A silent call is one where the person answers and hears nothing, usually because a predictive system dialled more numbers than it had agents free. Ofcom’s persistent misuse statement of 20 December 2016 says “Calling parties should not make silent or abandoned calls”, and its penalties can reach £2 million. This is general information, not legal advice.

Can I call my existing customers if they are on the TPS?

Not on the strength of being customers. Regulation 21 has no existing-customer exemption, so a customer registered on the TPS or Corporate TPS may receive marketing calls only if they have specifically consented to calls from you. Record that consent on the lead, with its source. This is general information, not legal advice.

What counts as an automated call under PECR?

PECR’s regulation 19 deals with an “automated calling or communication system” transmitting “sounds which are not live speech”, such as a recorded message. Marketing by that route needs consent. A live call from a person, even when software picked the next number, falls under the live-call rules of regulation 21 instead. This is general information, not legal advice.

Must the caller’s number display on UK marketing calls?

Yes. PECR does not let marketing callers withhold their number, and ICO guidance says to display your number or an alternative contact number and give an address or freephone number if asked. A SIM-based call from The Auto Dialer shows the caller’s own mobile number, so check staff are happy for customers to see that number. This is general information, not legal advice.
